Upsell feature does not seem to work when

The upsell feature does not seem to work when we have a license agreement attached to a product and the license agreement displays when someone tries to add the item to their cart. There's no problem with items that don't have a license agreement. In that case, the product accessories page displays as it should. Is there a way to get this feature to work with products that have a license agreement? We have version 7.0.3
