HTML Validation Errors

I would like to see future versions correct some minor HTML validation errors I'm seeing when validating our pages at validator.w3.org. Specifically, I see a lot of errors where the type attribute is left off <script language="javascript"> tags. This will not pass validation. There are several other errors, particularly with the use of "&" in some of the scripts. I'm not sure if it is possible to escape the "&" so that those would also pass validation, but it would be nice to be able to pass validation and per my SEO consultant, may also positively affect spidering by search engines.
